Terms of Use

On this page

Effective date: October 15, 2026

These Terms of Use (these "Terms") are an agreement between you and Ringba, LLC ("TCPA.com," "we," "us" or "our"), which owns the TCPA.com website. They govern your access to and use of the TCPA.com website, newsletter and related services (together, the "site"). By accessing or using the site, subscribing to the newsletter or submitting any form on the site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site.

PLEASE READ SECTIONS 1 AND 7 THROUGH 13 CAREFULLY. THEY DISCLAIM WARRANTIES, LIMIT OUR LIABILITY, REQUIRE YOU TO INDEMNIFY AND RELEASE RINGBA, LLC AND THE PEOPLE WHO WRITE AND RUN TCPA.COM, AND REQUIRE YOU TO RESOLVE DISPUTES BY BINDING INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, WITH NO JURY TRIAL AND NO CLASS ACTIONS.

THE SITE IS NOT A SUBSTITUTE FOR THE ADVICE OF AN ATTORNEY. NOTHING ON THE SITE IS LEGAL ADVICE.

The site provides general information about the Telephone Consumer Protection Act (TCPA) and related federal and state laws, for educational purposes only. It does not take your facts into account, and the law that applies to you may be different from what the site describes. TCPA.com is not a law firm and does not provide legal services. Using the site, subscribing to the newsletter or contacting us does not create an attorney-client relationship, or any other professional, fiduciary or confidential relationship, with TCPA.com or with anyone who writes for the site. Some people who write for the site may be lawyers; when they write for the site, they are not acting as your lawyer. Sending us a message does not stop any legal deadline from running, and we have no duty to respond. See also our Disclaimer.

2. Using the site

You may view, download and print pages for your own personal, noncommercial use or for internal business reference. You agree not to:

  • copy, republish or redistribute substantial portions of the site without our written permission, except as permitted by law;
  • use the site in any manner that violates any law;
  • interfere with the site's operation or security, or try to gain unauthorized access to it;
  • use automated means to collect content from the site in a way that burdens it; or
  • use the site's content to train or improve artificial intelligence or machine learning models without our written permission.

We may suspend, restrict or block access to all or part of the site at any time, for any reason, without notice.

3. Ownership

The site's original content, design and branding are owned by Ringba, LLC or its licensors and are protected by law. Statutes, regulations, court opinions and other government works quoted or linked on the site are not claimed as ours.

4. Contact and newsletter forms

When you submit the contact form or subscribe to the newsletter, you agree that we may use the information you provide as described in our Privacy Policy. By subscribing, you consent to receive email newsletters and marketing from TCPA.com, Ringba, LLC and their affiliates, which may be sent daily, weekly, monthly, or whenever we publish news we feel is important. You may unsubscribe at any time using the link in any email. You agree that what you submit is accurate and that you have the right to send it. Do not submit confidential information. If you send us suggestions, corrections or other feedback, we may use them for any purpose without obligation or compensation to you.

5. Analytics and advertising tools

The site uses Google Tag Manager, Google Analytics and the Meta Pixel. The Meta Pixel is not loaded when your browser sends a Global Privacy Control signal. Our Privacy Policy describes these tools and your choices.

The site links to government websites, court websites and other third-party sites. Links are provided for convenience only and do not mean we endorse those sites. We do not control them and are not responsible for their content, availability or privacy practices.

7. Disclaimer of warranties and no reliance

7.1 Get your own legal advice. You must get your own legal advice from a qualified lawyer licensed in your jurisdiction before you take, or decide not to take, any action relating to the TCPA, telemarketing, text messaging, email, lead generation, privacy or any other law. Nothing on the site, in the newsletter or in any communication from TCPA.com or its contributors is legal advice, and nothing on the site should be considered or treated as legal advice.

7.2 You will verify every action with a lawyer. You agree to review and verify every action you take, including every marketing, compliance, contracting, dispute and litigation decision, with your own lawyer before you take it.

7.3 No reliance. You agree that you will not rely, and have not relied, on any content on the site or in the newsletter as the basis for any decision or action. This includes articles, guides, case summaries, glossary entries, research guides, sources, dates, status labels and any opinion or statement by any contributor. Any reliance on such content is entirely at your own risk.

7.4 No guarantee of accuracy. The law in this area changes often, courts disagree, and summaries can be incomplete or wrong. TCPA.com disclaims the accuracy, completeness, timeliness, currency, reliability and suitability of all content on the site and in the newsletter. Content may be out of date, incomplete or in error, and we have no obligation to update or correct it.

7.5 No promise of a legal result. WITHOUT LIMITING SECTION 7.6, NO TCPA.COM PARTY (DEFINED IN SECTION 9.1) WARRANTS OR REPRESENTS THAT ANY CONTENT STATES THE LAW THAT APPLIES TO YOU OR THE LAW IN EFFECT WHEN YOU READ IT, OR THAT FOLLOWING ANY CONTENT WILL MAKE ANY CALL, TEXT MESSAGE, CONSENT PROCESS, SCRIPT, POLICY OR PRACTICE LAWFUL, OR WILL PREVENT ANY CLAIM, DEMAND LETTER, LAWSUIT, INVESTIGATION, FINE OR PENALTY.

7.6 As is. THE SITE, THE NEWSLETTER AND ALL CONTENT, INFORMATION AND MATERIALS ON OR AVAILABLE THROUGH THEM ARE PROVIDED "AS IS," "AS AVAILABLE" AND "WITH ALL FAULTS," WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, TCPA.COM AND THE TCPA.COM PARTIES (DEFINED IN SECTION 9.1) EXPRESSLY DISCLAIM ALL WARRANTIES, REPRESENTATIONS AND CONDITIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE OR ANY CONTENT WILL BE ACCURATE, CURRENT, COMPLETE, RELIABLE, UNINTERRUPTED, SECURE OR ERROR FREE, THAT ANY DEFECT WILL BE CORRECTED, OR THAT THE SITE OR ANY EMAIL WE SEND IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM TCPA.COM OR THROUGH THE SITE CREATES ANY WARRANTY. YOUR USE OF THE SITE IS AT YOUR SOLE RISK. IF APPLICABLE LAW DOES NOT ALLOW AN IMPLIED WARRANTY TO BE DISCLAIMED, THAT WARRANTY IS LIMITED TO THE NARROWEST SCOPE AND SHORTEST DURATION THE LAW ALLOWS. SECTION 13 LISTS SPECIFIC STATE EXCEPTIONS.

8. Limitation of liability

8.1 No indirect damages. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TCPA.COM OR ANY TCPA.COM PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOSS OF GOODWILL, LOSS OF DATA, COST OF SUBSTITUTE SERVICES, FINES, PENALTIES, SETTLEMENT AMOUNTS, JUDGMENTS, ATTORNEYS' FEES, OR COSTS OF RESPONDING TO ANY CLAIM, DEMAND LETTER, LAWSUIT, INVESTIGATION OR REGULATORY INQUIRY, ARISING FROM OR RELATED TO THE SITE, THE NEWSLETTER, ANY CONTENT, YOUR RELIANCE ON ANY CONTENT OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.2 Cap. TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF TCPA.COM AND ALL TCPA.COM PARTIES COMBINED FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE, THE NEWSLETTER, ANY CONTENT OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) OR (B) THE TOTAL AMOUNT YOU PAID TO TCPA.COM FOR USE OF THE SITE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE FIRST CLAIM. THE SITE IS FREE, SO UNLESS YOU HAVE PAID TCPA.COM FOR USE OF THE SITE, THE AMOUNT IN (B) IS ZERO.

8.3 Scope. THE LIMITATIONS IN THIS SECTION 8 APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE, AND THEY APPLY TO CLAIMS BASED ON THE NEGLIGENCE OF ANY TCPA.COM PARTY. Nothing in these Terms, including Sections 9 and 10, excludes, limits or releases, or requires you to indemnify any TCPA.com Party against, any liability of a TCPA.com Party for its own fraud or intentional misrepresentation, its own willful misconduct or gross negligence, death or bodily injury caused by its negligence, or any other liability that applicable law does not allow to be excluded or limited (together, "Excluded Liability"). Section 13 lists specific state exceptions.

8.4 Your exclusive remedy. If you are dissatisfied with the site or any content, your sole and exclusive remedy is to stop using the site.

8.5 Time limit for claims. To the fullest extent permitted by law, and except as stated in Section 13, any claim arising from or related to the site, the newsletter, any content or these Terms must be brought within one (1) year after the claim arises, or it is permanently barred.

8.6 Reasonable allocation of risk. You acknowledge that TCPA.com provides the site free of charge, that Sections 1 and 7 through 12 are an essential basis of the bargain between you and TCPA.com and reflect a reasonable allocation of risk, and that TCPA.com would not provide the site without them. If any part of Sections 7 through 10 is held unenforceable, it will apply to the maximum extent allowed, and the rest of those sections will continue to apply.

9. Indemnity

9.1 Who is protected. In these Terms, "TCPA.com Parties" means TCPA.com and each of its past, present and future owners, editors, authors, contributors, officers, employees and agents, and their heirs, successors and assigns. Each of them is protected both in a business capacity and personally. These Terms protect the TCPA.com Parties only for matters arising from or related to the site, its content, the newsletter or the forms on the site.

9.2 Your promise. To the fullest extent permitted by law, you will defend, indemnify and hold harmless each TCPA.com Party from and against all Losses arising from or related in any way to:

  • your access to or use of the site or the newsletter, or your reliance on any article, guide, case summary, glossary entry, newsletter or other information that TCPA.com publishes or sends;
  • your marketing, sales, lead and communications practices, and those of anyone acting for you or with you, including telephone calls, text messages, prerecorded or artificial voice messages, autodialers and other dialing technology, emails, faxes, lead generation, buying, selling or sharing leads or consent records, and pay per call campaigns;
  • your interpretation or application of any law, regulation, rule or guidance, including the Telephone Consumer Protection Act and the Federal Communications Commission's rules under it, the Federal Trade Commission's Telemarketing Sales Rule, the CAN-SPAM Act, state telemarketing laws, state laws modeled on the TCPA (often called mini-TCPA laws), state do-not-call laws, and consumer protection and privacy laws;
  • any demand letter, claim, lawsuit, arbitration, regulatory inquiry or investigation that you receive, bring or are involved in, including any matter in which a TCPA.com Party is named, served with a subpoena, or asked for documents, information or testimony;
  • your breach of these Terms, or your violation of any law or of anyone else's rights; or
  • anything you submit to TCPA.com or through the site, including through the contact form or the newsletter signup.

9.3 What "Losses" means. "Losses" means all claims, demands, demand letters, lawsuits, arbitrations, subpoenas, regulatory inquiries, civil investigative demands, investigations and other proceedings, whether threatened or actual, and everything that results from them: judgments, awards, settlements, fines, penalties, damages, liabilities, costs and expenses, including reasonable fees of attorneys, experts and other professionals, the cost of responding to subpoenas and requests for information, and the cost of enforcing Sections 9 and 10.

9.4 Even if a TCPA.com Party was at fault. YOUR OBLIGATIONS UNDER THIS SECTION 9 APPLY EVEN IF A LOSS IS CAUSED OR ALLEGED TO BE CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF ANY TCPA.COM PARTY (WHETHER SOLE, CONCURRENT, ACTIVE OR PASSIVE), BY STRICT LIABILITY, OR BY ANY ERROR, OMISSION, INACCURACY OR OUT-OF-DATE INFORMATION ON THE SITE OR IN THE NEWSLETTER. They do not apply to the extent a court or arbitrator finally determines that a Loss arises from Excluded Liability (defined in Section 8.3).

9.5 Claims you bring yourself. This Section 9 covers claims you bring, not only claims brought by others. If you bring a claim, counterclaim or third-party claim against any TCPA.com Party, in court or in arbitration, you will pay that TCPA.com Party's Losses from the claim, including reasonable attorneys' fees and costs, if the claim is dismissed or withdrawn, is decided in that TCPA.com Party's favor, or is barred by Section 10. You and TCPA.com intend this Section 9.5 as an express agreement to shift attorneys' fees.

9.6 Defense and settlement. Each TCPA.com Party may choose either to have you defend the matter at your expense, with counsel that the TCPA.com Party reasonably approves, or to control its own defense with counsel of its choice, in which case you will pay the reasonable cost of that defense. You will pay defense costs as they are incurred, within 30 days after receiving an invoice. You will cooperate fully, including by providing records, information and testimony that a TCPA.com Party reasonably requests. You will not settle any matter that involves a TCPA.com Party without that party's prior written consent, unless the settlement fully and unconditionally releases every TCPA.com Party, includes no admission of fault by any of them, and requires nothing from any of them other than a payment that you make in full. A delay in telling you about a matter reduces your obligations only to the extent the delay actually and materially harms your ability to defend it.

9.7 The individuals can enforce this. Protecting the individual TCPA.com Parties from personal liability is a material purpose of these Terms. Each TCPA.com Party is an intended third-party beneficiary of Sections 7 through 12 and may enforce them directly against you. Apart from the TCPA.com Parties, no one is a third-party beneficiary of these Terms.

9.8 How Sections 9 and 10 work with the rest of these Terms. Except as Sections 8.3 and 13 provide, Sections 9 and 10 are in addition to, and are not limited by, any other part of these Terms, including the limitation of liability. They apply to Losses arising from anything that happened while these Terms applied to you, and they continue to apply after you stop using the site, unsubscribe from the newsletter, or these Terms end or change. If any part of Section 9 or 10 is found unenforceable, it will be enforced to the greatest extent the law allows, and the rest will remain in effect.

9.9 What Sections 9 and 10 do not do. Nothing in Section 9 or 10 limits your right to share an honest review or opinion of the site, or to report a possible violation of law to a government agency or cooperate with one.

10. Release and promise not to sue

10.1 Your responsibility. You agree that the site offers general information only, not legal advice; that telemarketing, texting, email and privacy laws change often and differ from state to state; and that you alone are responsible for your marketing and compliance decisions, which you should make with your own lawyer.

10.2 Release. To the fullest extent permitted by law, you release and forever discharge each TCPA.com Party from all claims, demands, damages and liabilities of every kind, known or unknown, arising from or related to the site, the newsletter, any information on or from them, your reliance on that information, any marketing or compliance decision you make, or any actual, potential or perceived conflict of interest of any TCPA.com Party, whether or not known or disclosed. THIS RELEASE INCLUDES CLAIMS BASED ON THE NEGLIGENCE OF ANY TCPA.COM PARTY AND CLAIMS BASED ON ANY ERROR, OMISSION, INACCURACY OR OUT-OF-DATE INFORMATION ON THE SITE OR IN THE NEWSLETTER. It does not release any claim for Excluded Liability (defined in Section 8.3) or any other claim that the law does not allow to be released.

10.3 Promise not to sue individuals. You agree not to sue, or bring any claim or proceeding against, any individual TCPA.com Party personally for anything arising from or related to the site, its content or the newsletter, except a claim for that person's own Excluded Liability (defined in Section 8.3). Any other claim you believe you have may be brought, if at all, only against TCPA.com, and remains subject to these Terms, including the limitation of liability and Section 12. If you break this promise, Section 9.5 applies to that claim.

10.4 Unknown claims. You understand that you may later learn facts different from those you now know or believe, and you agree that this release still applies. You waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You also waive any similar law of any other state.

11. Changes to the site and these Terms

We may change, suspend or discontinue any part of the site at any time, without notice. We may change these Terms at any time, without notice to you, by posting the updated Terms on this page. Changes take effect when they are posted, and the effective date at the top of this page shows when these Terms were last updated. Your continued use of the site after changes are posted means you accept the updated Terms. Changes to Section 12 do not apply to any dispute that arose before the change was posted; that dispute is governed by Section 12 as it read when the dispute arose.

12. Governing law, arbitration and disputes

12.1 Governing law. These Terms are governed by the laws of the State of Delaware, without reference to its conflict of laws principles (but excluding the United Nations Convention on Contracts for the International Sale of Goods); provided, however, that the Uniform Computer Information Transactions Act will not apply even if adopted as part of the laws of the State of Delaware.

12.2 Notice of claim first. For any dispute described in Section 12.3, you must first give TCPA.com an opportunity to resolve it by sending written notice through our contact form and by mail to the address in Section 15, stating (i) your name, (ii) your address, (iii) a written description of your claim, and (iv) a description of the specific relief you seek. If TCPA.com does not resolve the dispute within 30 days after it receives your notice, you may pursue the dispute as set out in Section 12.3.

12.3 Binding arbitration. If any dispute arises between you and TCPA.com or any TCPA.com Party concerning the site, the newsletter, any content or the interpretation, validity or performance of these Terms or any of their provisions, including whether a dispute is arbitrable, (a) if the amount claimed by a party is equal to or less than the jurisdictional limit of the Delaware small claims court (the Justice of the Peace Court), the parties will resolve the matter in that court, or (b) if the amount claimed by a party exceeds that limit, the parties will submit the dispute to binding arbitration before a retired judge selected from JAMS or any similar organization mutually acceptable to the parties. The parties will mutually agree on one arbitrator from the list provided by the arbitrating organization; if they cannot agree, each party will select one arbitrator from the list, and the two arbitrators so selected will agree on a third arbitrator from the same list, who will decide the dispute. If JAMS will not administer the arbitration and the parties do not agree on another organization within 30 days, a court may appoint an arbitrator under 9 U.S.C. § 5. This Section 12 is governed by the Federal Arbitration Act, 9 U.S.C. § 1 and following. The arbitration will take place in Delaware and will be conducted under the then prevailing rules of the arbitrating organization, except as set out in this Section 12. The arbitrator will apply Delaware substantive law and Delaware evidentiary law. The arbitrator may grant all legal and equitable remedies, including provisional remedies, and award compensatory damages provided by law, but may not order relief greater than a court could order, and, except as Section 13 provides, may not award punitive or exemplary damages or any other damages not permitted under these Terms. The arbitrator will provide the parties with a written award including the factual findings and legal reasoning on which it is based. The arbitrator will award costs and attorneys' fees in accordance with these Terms, including Section 9.5. Any court having jurisdiction may enter judgment on the award, or correct or vacate it as provided by applicable law. By agreeing to binding arbitration, the parties understand that they are giving up the rights they may otherwise have to a trial by a court or a jury, to all rights of appeal and, except as Section 13 provides, to an award of punitive or exemplary damages. Pending the resolution of any arbitration, either party may apply to any court of competent jurisdiction for a provisional remedy, including a temporary restraining order or preliminary injunction (but excluding any dispute relating to discovery matters), and for enforcement of any such order. Applying for or enforcing a provisional remedy does not waive this agreement to arbitrate.

12.4 No class actions or jury trials. YOU AND TCPA.COM AGREE THAT EACH MAY BRING CLAIMS DESCRIBED IN SECTION 12.3 AGAINST THE OTHER, OR AGAINST ANY TCPA.COM PARTY, ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate the claims of more than one person or preside over any form of class, collective or representative proceeding. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND TCPA.COM EACH WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY DISPUTE DESCRIBED IN SECTION 12.3. If this Section 12.4 is found unenforceable as to any claim, that claim will be severed and decided by a court under Section 12.5, and the rest of this Section 12 will continue to apply.

12.5 Venue. Subject to this Section 12, the exclusive venue for any suit or proceeding arising from or related to the site or these Terms will be the appropriate federal or state court located in Delaware, and you expressly consent to the exclusive jurisdiction of those courts and waive any objection to venue there.

12.6 NOTICE OF ARBITRATION AGREEMENT. This agreement provides that all disputes between you and TCPA.com described in Section 12.3 will be resolved by BINDING ARBITRATION. You thus GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract (EXCEPT for matters that may be taken to SMALL CLAIMS COURT). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury. You are entitled to a FAIR HEARING, BUT the arbitration procedures are generally SIMPLER AND MORE LIMITED THAN RULES APPLICABLE IN COURT. Arbitrator decisions are as enforceable as any court order and are subject to VERY LIMITED REVIEW BY A COURT.

13. State-specific exceptions

Some states do not allow certain warranties to be disclaimed, certain damages to be excluded or limited, or the time to bring a claim to be shortened. The following exceptions apply notwithstanding anything else in these Terms, including Sections 8.6, 9.8 and 12, and the rest of these Terms continues to apply to you.

  • Maryland. If you are a "consumer" in Maryland as defined in Maryland Commercial Law § 13-101, Section 8.5 does not apply to you; nothing in these Terms waives, limits, impairs or disclaims any statutory damages, punitive damages, declaratory relief or injunctive relief authorized by federal or Maryland law; and nothing in these Terms waives or limits any other right or manner of enforcement protected by Maryland Commercial Law § 14-1328.
  • Texas. If Texas law governs the time to bring your claim, the period in Section 8.5 is two (2) years instead of one (1) year.
  • California. If California law applies to your claim, nothing in these Terms exempts any TCPA.com Party from responsibility for its own fraud, willful injury to the person or property of another, or violation of law, to the extent California Civil Code § 1668 does not allow it.
  • New Jersey. If you are a New Jersey resident, Sections 7 through 10 apply to you in full, except that the carve-outs in Section 8.3 apply and the exclusions of punitive damages in Sections 8.1 and 12.3 do not apply to you.
  • Other states. If the law of the state where you live does not allow any other part of Sections 7 through 10 to apply to you, that part applies only to the fullest extent that law allows.

14. General

If any provision of these Terms is held to be invalid, illegal or unenforceable in any respect, that will not affect any other provision, and these Terms will be construed as if the invalid, illegal or unenforceable provision had never been included, except as Sections 8.6, 9.8, 12.4 and 13 provide otherwise. Our failure to enforce any provision is not a waiver of it. We may assign these Terms without notice; you may not assign them without our written consent. Sections 1 through 4 and 7 through 15 survive any termination of these Terms or of your use of the site. Section headings are for convenience only. These Terms, together with our Privacy Policy, Disclaimer and Editorial Policy, are the entire agreement between you and TCPA.com regarding the site. They do not govern any product or service that Ringba, LLC or its affiliates provide under a separate agreement, such as the Ringba call tracking and pay per call platform. That agreement alone governs that product or service, and nothing in these Terms changes it; these Terms still govern the site and its content.
